CASE NUMBER: 26PC-0033493 This matter is on calendar for hearing on a Petition for Appointment of a Conservator of the Person and Estate. The matter has not been properly noticed. There is no proof of service of the Notice of Hearing and Petition for the sibling Kayden, maternal grandparents, or paternal grandparents. Proof of service of the Citation has been filed, however the Citation issued for today’s date is incomplete as to items 1 and 3. The Petition contains the following defects: 1. The Petition states that the proposed conservatee has a developmental disability. Thus, it appears that this should be designated as a Petition for Appointment of a Limited Conservator in the Caption. It is so designated in Item 1a.
2. Under item 1, the Petition is incomplete as to what authority Petitioner is seeking as Conservator. Items 1(d)-(l) must be completed as applicable.
An application and order appointing counsel for the Conservatee has not been filed. The Court appoints the Public Defender as counsel for the Conservatee. The Capacity Declaration has been filed and is accepted by the Court. The Court Investigator has requested additional time to complete the investigation and report. The matter is continued to Monday, September 21, 2026, at 2:30 p.m. in Department 44 for further proceedings on the Petition for Appointment of a Conservator of the Person and Estate.
Petitioner is required to file and serve an amended Petition to address the issues raised above. Additionally, Petitioner is required to file and serve a new Notice of Hearing for the continued hearing date, along with a copy of the amended Petition, on all parties entitled to notice. A new Citation is required to be issued and served for the continued hearing date and proof of service filed with the court. No appearance is necessary on today’s calendar.
