ORDER RE: CASE MANAGEMENT
The Court has ordered the following after review of the case.
The Court makes the following order after review of the case without a hearing:
This case was STAYED until the BSA bankruptcy proceeding in Delaware was final and all appeals from the March 28, 2023 order confirming the BSA reorganization plan had been exhausted.
This action was also STAYED until all appeals were exhausted in the following California Court of Appeal case numbers as to the constitutionality of AB 218: A169013, A169314, A169354, A169747, and B334707.

Plaintiff filed a status report in Alameda County Superior Court Case No. 22CV023598 indicating that all appeals have been exhausted and the Order confirming the Chapter 11 Plan of Reorganization is now final.
The Court will continue the proceeding to allow parties an opportunity to address the matter in light of the ramifications of finality of the Plan and its impact on the claims against the defendant(s) to this action.
The parties shall file a status report in advance of the continued CMC setting forth next steps for litigation in this trial court.
The Case Management Conference Re: Status of bankruptcy and appeals scheduled for 08/14/2026 is continued to 02/24/2027 at 11:00 AM in Department 520 at Hayward Hall of Justice.
