PARTIES TO APPEAR.
Formosa's opposition contends, in essence, that there is nothing for it to further produce. However, this contention is at odds with deposition testimony elicited from its witnesses, Mr. Abbott and Ms. Ho. Therefore, the parties should be prepared to discuss the following:
• There appears to be testimony regarding a storeroom in Livingston, NJ, but Defendant has not addressed Plaintiffs assertions that it might contain responsive documents. • • Mr. Abbotts testimony regarding 5-6 bankers boxes worth of documents, apparently including corporate governance records, board minutes, and financial performance documents. Is it Formosas position that there were no responsive documents in those boxes’ o If so, is Formosa prepared to so declare’ o If not, what is Formosas reasoning for failing or refusing to produce responsive documents?
• Ms. Ho testified that she was told by her legal department that documents pertaining to JMM were removed by its personnel in 2005. Did Ms. Ho undertake any searches to confirm this assertion’ o If so, what search(es) did she conduct?
