On April 24, 2026, Respondent filed a Request for Order (RFO) seeking child support orders. It was served on April 27th. She filed and served her Income and Expense Declaration on May 5th. She filed and served another Income and Expense Declaration on May 7th.
Petitioner filed his Income and Expense Declaration on May 8th, it was served on April 27th. Petitioner filed his Responsive Declaration to Request for Order and his updated Income and Expense Declaration on July 29th.
“For all hearings involving child, spousal, or domestic partner support, both parties must complete, file, and serve a current Income and Expense Declaration.” Cal. Rule Ct. 5.260(1); See also Cal. Fam. Code §2100. “’Current’ means the form has been completed within the past three months providing no facts have changed.” Cal. Rule Ct. 5.260(3). Here, Respondent’s Income and Expense Declaration is just outside the three month period. The parties are ordered to appear for the hearing. Respondent is ordered to bring with her an updated Income and Expense Declaration with supporting documents. Both parties are ordered to bring their proposed Xspouse reports.
TENTATIVE RULING #10: THE PARTIES ARE ORDERED TO APPEAR FOR THE HEARING. RESPONDENT IS ORDERED TO BRING WITH HER AN UPDATED INCOME AND EXPENSE DECLARATION WITH SUPPORTING DOCUMENTS. BOTH PARTIES ARE ORDERED TO BRING THEIR PROPOSED XSPOUSE REPORTS.
