Defendant Mozilla Corporation's motion to seal certain information filed conditionally under seal on July 7, 2026 is denied. Assuming without deciding that there is an overriding interest of abiding by contractual confidentiality provisions and that overriding interest supports sealing court records, Mozilla has not shown by the required "facts" (CRC 2.551(b)(1)) that a substantial probability exists that the overriding interest will be substantially prejudiced if the identity of the third-party purchaser of pocket.com is not sealed. The declaration of Mozilla's general counsel is wholly conclusory and conjectural on that critical point.
The only materials filed conditionally under seal that are sought to be sealed are unredacted versions of the ex parte application and the Declaration of Neha Anderson without exhibits filed July 7, 2026. The unredacted versions of those documents will now be filed without sealing. The court does not have exhibits H, J and Q to the Anderson Declaration, so the portion of this motion directed to those exhibits is off calendar. While the court does have an unredacted version of the proposed order that was lodged on July 7, 2026, that document. like all proposed orders that do not become orders of the court, has not nor will it ever be filed and is maintained and will remain in a file that is not available to the public, so the portion of this motion directed to the proposed order is also off calendar.
