Compliance Hearing; Order to Show Cause re Sanctions

The Compliance Hearing is CONTINUED TO JULY 8, 2026, AT 9 AM IN THIS DEPARTMENT and the 2/4/2026 Order to Show Cause re Sanctions is DISCHARGED. NO APPEARANCE REQUIRED.
Good cause appearing, The Compliance Hearing is continued to July 8, 2026, at 9:00 a.m. in this department. The Order to Show Cause is discharged without sanctions being imposed. No personal appearance is required.
At this point in the proceeding, the court will not approve the cy pres approach. The parties need to submit a firm plan for a prompt third distribution or prompt deposit of the residual uncashed funds with the State Controller in the name of the participating class member. Ultimately, residual uncashed funds will have to be deposited with the State Controller in the name of the participating class member.
At least ten court days before the next hearing, Plaintiff must file a declaration or declarations from appropriate parties articulating the plan for final distribution with a firm deadline for each action. Courtesy copies must be provided to the court within one court day of filing. Plaintiff is ordered to prepare a proposed order which repeats verbatim the above text and email it to contestdept302tr@sftc.org prior to the time set for this hearing.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept302tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
