TENTATIVE RULING:
Plaintiffs Kathleen Charles, by and through her successor-in-interest, Erika Wright; Erika Wright, individually; Raymond Gregory Charles, individually; and Thomas Wright, individuallys (Plaintiffs) motion to set trial and trial-related dates is UNOPPOSED and GRANTED, as follows.
Plaintiffs filed this elder abuse action on June 17, 2025.
Defendants filed a Motion to Compel Arbitration, which the Court denied on October 20, 2025. On October 24, 2025, the Court granted Plaintiffs Motion for Trial Preference and ordered that the case be brought to trial on or before February 17, 2026.

On October 29, 2025, Defendants filed a notice of appeal regarding the Courts denial of their motion to compel arbitration, and discovery was stayed during the pendency of the appeal. On March 18, 2026, the Third District Court of Appeal affirmed the Courts ruling denying Defendants motion to compel. Thereafter, a remittitur was received by the Court on June 4, 2026.

Plaintiffs now move for an advance trial setting under Code of Civil Procedure section 36, subdivision (f), which requires a trial to be set no more than 120 days from the date a motion for preference is granted. Since trial preference was previously granted, and the case has been returned to the Court via remittitur, Plaintiffs request a trial date of December 7, 2026, and a Trial Status Conference of November 16, 2026.
No opposition to the motion has been filed.
The Court agrees that Plaintiff is entitled to an advanced trial date under the circumstances.
Trial is set for December 7, 2026, at 8:30 a.m. in Department 17A. A Mandatory Settlement Conference is set for November 2, 2026, at 9:30 a.m. in Room 450. Trial Status Conferences are generally not scheduled in Department 17A unless an action receives a pre-assignment for trial to a particular judge/department.
This minute order is effective immediately. No formal order or other notice is required. (Code Civ. Proc., § 1019.5; Cal. Rules of Court, rule 3.1312.)
*** This case has been assigned to Department 17A for hearing. In the event that either party requests a hearing the matter will be heard at 9:30 a.m. in Department 17A.
