The Court's Tentative Ruling is to GRANT Plaintiff's Motion.
Defendant made a filing on 8/11/26 with the Court but an Opposition filing one day prior to a Motion hearing date is untimely. The Court has read the Opposition papers and is concerned that the Plaintiff's lawyers were not timely served with it, in order to read and respond to it. The Court is also concerned that the circumstances that Defendant described in the Opposition papers, while real-life occurrences and deserving of the Court's sympathy, do not present a valid defense to the terms of the Settlement Agreement/contract.
Moreover, there is NO reviewable 'Proof of Service by Mail" filed by Plaintiff in the court record as of the date of this Order. Thus the Court is unsure Plaintiff has received or read Defendant's Opposition filed today 8/11/26.
If the filing was served by Mail on Plaintiff's lawyers as of the date of filing [today] 8/11/26, it legally takes five (5) days to reach them within California. The Court cannot consider any filings that the Other Party hasn't received or had the opportunity to respond to.
Defendant is advised: If the Plaintiff's moving papers state an amount for Judgment that has changed due to recent post-motion filing payments by Defendant, Plaintiff has an obligation to update the Court and if the Motion is GRANTED provide an updated [proposed] Order and Judgment that reflects the correct amount. ______________________________________________________________________________ ___
