The Court orders the following after review of the case.
Order to Show Cause Re: Dismissal Compliance Per CRC 3.1385 is scheduled for 11/17/2026 at 3:00 PM in Department 22 at Rene C. Davidson Courthouse.
A Notice of Settlement was filed on 8/10/26. Plaintiff and all cross-complainants shall promptly file requests for dismissal no later than 45 days of the Notice of Settlement pursuant to California Rules of Court, rule 3.1385.
The parties are ORDERED to meet and confer in good faith and on a timely basis and to use reasonable diligent efforts to finalize the settlement and settlement agreement.
The Court places this matter on the dismissal compliance calendar and sets a hearing on an ORDER TO SHOW CAUSE in re SANCTIONS and/or DISMISSAL if requests for dismissal are not filed before the Order to Show Cause hearing date.
Plaintiff and all cross-complainants are ordered to show cause why the complaint and any crosscomplaint should not be dismissed by the Order to Show Cause hearing date.
Plaintiff and all cross-complainants are ordered to show cause in sworn DECLARATIONS/RESPONSES and at the hearing why the complaint and/or cross-complaint should not be dismissed WITHOUT PREJUDICE, with the Court retaining jurisdiction pursuant to Code Civ. Proc. § 664.6(e).
The written responses to the order to show cause must be filed, served, with courtesy copy emailed to department clerk, no later than 11/9/26.
Note that delays in payment and/or installment payments of settlement funds do not preclude dismissal without prejudice because the Court retains jurisdiction to enforce the settlement.
Failure to demonstrate good cause for delay will result in sanctions or the dismissal of the case, pursuant to California Rules of Court, rule 3.1385
