Petition to Compel Arbitration
Defendants’ unopposed petition to compel arbitration is granted.
No attorneys’ fees are awarded at this time. Defendants have failed to establish that there is a fee shifting provision entitling them to attorneys’ fees for the filing of a petition to compel arbitration or allowing those attorneys’ fees to be awarded by a court when a party has elected to arbitrate.
No sanctions are imposed. Code of Civil Procedure section 1281.97 does not authorize any sanctions on the consumer. Defendants cite no valid legal authority for imposition of sanctions against a party simply for refusing to stipulate to arbitration of a dispute.
The action shall be stayed until the arbitration is had. (Code Civ. Proc. § 1281.4.)
