Review: Investigator's Report
Probate Notes: No appearances required. Petition is recommended for approval with one change to the proposed order as to Valeria Chiyal. A guardianship terminates by operation of law upon the death of the ward or the ward reaching the age of majority. (Prob. Code Sec.1600; CRC, Rule 7.1004(b)(2).) However, a guardian cannot be discharged from liability until one year from age of majority. (i.e. 19yrs) (Prob. Code., Sec. 2627.) Since Valeria turned 19 on May 15, 2026, the guardian may be discharged upon the filing of a release of liability by the ward. This may be done by having the ward appear at the hearing and stating on the record that the ward releases the Guardian from liability, or by Ex Parte Petition for Final Discharge with a receipt notarized by the ward.
