Plaintiff has failed to carry its burden. The evidence on which Plaintiff relies includes multiple declarations under penalty of perjury by a declarant who admits to previously signing an untrue declaration under penalty of perjury, and unauthenticated documentary evidence.
Plaintiff's Requests for Judicial Notice of (1) Defendant's Employment Separation Letter; and (2) Plaintiff's Response to Defendant's Reasonable Accommodation Request, are DENIED. Plaintiff offers no explanation of why the Court may take judicial notice of either of these documents. =(501/CFH)
