Tentative Ruling
Claimant Jerry Millers (Claimant) motion to compel arbitration and appoint an arbitrator in an uninsured motorist action is UNOPPOSED and GRANTED.
Claimant made an uninsured motorist claim with Respondent Bristol West (Respondent). Claimant demanded arbitration and made reasonable efforts to have the matter determined. Respondent has failed to comply and agree to an arbitrator and set this matter for Arbitration.
Claimant requests the Court to appoint Fred Wiesner, Esq. or Nick Lowe, Esq. to serve as Arbitrator and that the arbitration take place within 60-120 days of the hearing date on this matter.
The Court construes Respondents failure to oppose the motion as a concession on the merits. (D.I. Chadbourne, Inc. v. Superior Court (1964) 60 Cal.2d 723, 728, fn. 4 [where nonmoving party fails to oppose a ground for a motion, it is assumed that [nonmoving party] concedes that ground].)
Fred Wiesner. Esq. is appointed as arbitrator. If Mr. Wiesner is unable to serve, Nick Lowe, Esq. shall be appointed in his stead.
Arbitration is to take place within 60-120 days of the date of this order.
The minute order is effective immediately. No formal order pursuant to California Rules of Court, rule 3.1312 or further notice is required.

Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government code §68086 and California Rules of Court, Rule 2.956. A Stipulation and Appointment of Official Reporter Pro Tempore (CV/E-206) is required to be signed by each party, the private court reporter, and the Judge prior to the hearing, if not using a reporter from the Courts Approved Official Reporter Pro Tempore list.
Once the form is signed it must be filed with the clerk. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporters Office and an official reporter will be provided.
