Tentative Ruling - 08/10/2026 Han N. Tran
The Motion re: NOTICE OF MOTION AND DEFENDANT KWONG LAI'S MOTION FOR EQUITABLE RELIEF, ACCOUNTING, AND LIMITED STAY OF ENFORCEMENT filed by Kwong Lai on 06/23/2026 is Denied.
Defendant Kwong Lais motion for equitable relief, accounting, production of accounting records, and limited stay of enforcement is DENIED. The judgment is final and Defendants appeal was denied. Defendant does not set forth good cause to revisit the calculation of the judgment, and some of the issues raised in Defendants motion were already considered and ruled upon by this court during trial. Moreover, as Plaintiff notes, the court lacks equitable jurisdiction to stay execution of the judgment as Defendant requests because Defendant does not set forth an extrinsic mistake meriting such relief.
If the matter is contested, the hearing will be held on August 12, 2026 at 3:00pm instead of August 11, 2026 at 3:00pm. (NOTE THE NEW DATE)
