PETITIONER 931 SANCHEZ STREET LLC Notice Of Motion And Motion To Amend Judgment is DENIED. No proof of service re: judgment debtor Legacy United Capital Investments, Inc.
Additionally, counsel for Petitioner, 931 Sanchez Steet LLC (Richard Veres of Nichols, Catterton, Downing & Reed), states in his declaration at paragraph 6 that "Lina Lu, .., is married to Patrick [Lin]" and attaches the declaration of Ms. Lu as evidence in support of the motion. Said declaration refences case 931 Sanchez Street, LLC v. Legacy United Capital Investments Inc. et. al., CGC-25-624806.
In that case, counsel for Plaintiff, 931 Sanchez Steet LLC (James Reed of Nichols, Catterton, Downing & Reed), states in paragraph 20 of the amended verified complaint that "It appears from record title that defendant PATRICK LIN and his wife BI SHAN LIN are one-half (1/2) owners of the property. However, it is unknown whether defendant BI SHAN LIN is claiming separate property title or community property title in the property."
A person by the name "Lina Lu" is listed as a separate defendant in CGC-25-624806, i.e. not the same person as BI SHAN LIN. (See paragraphs 6 and 7 of the amended verified complaint).
