1. M-CV-0086393 LVNV Funding LLC v. Kumansky, Alex
Plaintiff is advised the notice of motion must include notice of the court’s tentative ruling procedures. (Local Rule 20.2.3(C).)
Motion to Enforce Settlement
Plaintiff moves to enforce the settlement agreement pursuant to Code of Civil Procedure section 664.6. The court previously continued this matter, noting that while there was evidence of service of the motion on an attorney, there was no evidence of service on defendant and there is nothing in the court’s file to show defendant had an attorney of record. (Law and motion minutes, Jun. 30, 2026.) The court directed plaintiff to serve all moving papers on defendant directly, file and serve a notice of continued hearing, and file all proofs of service with the court by July 7, 2026. (Ibid.) Plaintiff has not filed these documents. As the motion is supported by insufficient evidence of proper service to the defendant, the motion is denied without prejudice.
