Plaintiff's Motion for Entry of Judgment for Possession Pursuant to the Terms of the Settlement Agreement is DENIED without prejudice. Paragraph 1b of the Stipulation, as written, describes a condition precedent to any payment obligation of Defendant. It is therefore Plaintiff's burden to establish that its obligations under Paragraph 1b have been satisfied in order to show that Plaintiff is entitled to enforce the Stipulation against Defendant. However, Plaintiff's moving papers did not include any discussion of Paragraph 1b. Rather, Plaintiff submitted a new declaration regarding compliance with Paragraph 1b in reply only. Defendant has no opportunity to file opposition to this new evidence in reply.=(501/CFH)
