No discussion of the Defendant's express waiver of his right to seek this relief in the parties' written Stipulation. No showing that Defendant has or will make full payment and full performance of the conditions and covenants at issue as of the time this application is made. As this is a prerequisite condition of the relief requested, it is Defendant's burden to make an affirmative showing. Defendant's promise to perform in the future, or to cooperate with Plaintiff's efforts to confirm his performance in the future, does not meet the requirements of CCP 1179. =(501/CFH)
