Status of Pleadings and Trial Setting
CASE NUMBER: 23CV-0202926 This matter is on calendar for review regarding status of pleadings and trial setting. Plaintiff has still not answered the Cross-Complaint. At the last hearing on July 20, 2026, Plaintiff’s counsel stated that Plaintiff had not been served with the Cross-Complaint. Counsel for Cross-Complainants stated that the Cross-Complaint had been served. The Court notes that a proof of service is attached to the Cross-Complaint indicating electronic service on Plaintiff on June 4, 2026.
If Plaintiff does not file a responsive pleading, Cross-Defendants may seek entry of default. The matter is continued to Tuesday, September 8, 2026 at 9:00 a.m. in Department 63 for status of responsive pleading or default, and trial setting. The parties are ordered to file a status statement no less than five court days prior to the next hearing. No appearance is necessary on today’s calendar.
