On May 11, 2026, Respondent filed a Request for Order (RFO) seeking custody and visitation orders and a move away order. All required documents were served on May 20th.
Petitioner filed and served his Responsive Declaration to Request for Order on June 30. th
The parties attended Child Custody Recommending Counseling (CCRC) on June 26, 2026. They reached some agreements but could not agree on all issues therefore a report with the agreements and recommendations was prepared on July 21st; it was mailed to the parties on July 22nd.
Respondent’s Reply Declaration to Petitioner’s Responsive Declaration and Updating Declaration Regarding Custody was filed and served on July 28, 2026.
Petitioner filed and served his supplemental declaration on July 29th.
Respondent is requesting sole legal and sole physical custody of the minor and authorization to move the minor to Arizona.
Petitioner opposes the requests and instead he asks the court to order joint legal and joint physical custody. He requests weekly, unsupervised visits, and overnight visits with the minor with a step-up plan to equal parenting. He asks that exchanges take place at the Rocklin Target located at 5104 Commons Dr., in Rocklin. Finally, he asks the court to order a Family Code § 3111 evaluation at Respondent’s expense.
At the time of filing the parties were pending a trial on Respondent’s request for a Domestic Violence Restraining Order in case number 26FL0206. It appears hearing on that matter has been continued to March 10, 2027.
This matter is continued to join with the DVRO trial. All prior orders remain in full force and effect pending the DVRO trial.
TENTATIVE RULING #11: THIS MATTER IS CONTINUED TO JOIN WITH THE DVRO TRIAL. ALL PRIOR ORDERS REMAIN IN FULL FORCE AND EFFECT PENDING THE DVRO TRIAL.
