TENTATIVE RULING
Counsels Notice of Motion does not provide notice of the Courts tentative ruling system, as required by Local Rule 1.06(D). Counsel is directed to contact the opposing party and client forthwith to advise of Local Rule 1.06 and the Courts tentative ruling procedure. If Counsel is unable to contact the opposing party and client prior to the hearing, Counsel shall be available at the hearing, in person or remotely (telephonically or by video conference via Zoom as stated in the introductory notice to todays tentative rulings), in the event the opposing party or client appears without following the procedures set forth in Local Rule 1.06(B).
The motion of Counsel Jacob Brown (Counsel) to be relieved as counsel for plaintiff Diego Cordova Flores (Client) is UNOPPOSED and GRANTED. On August 1, 2025, the Court granted Counsels ex parte application and advanced the hearing on the instant motion to be relieved as counsel. Counsel filed an amended motion on July 2, 2026, in accordance with the deadline set forth in the Courts order.
Counsel has filed a declaration in support of the motion stating that Client no longer responds to counsels attempts at communication, no longer follows advice or suggestions, and the level of trust necessary to continue representation no longer exists. (Brown Decl., ¶ 1.)
Counsels supporting declaration and the corresponding proof of service indicate the papers in support of this motion have been served via mail on Client at his last known addresses, which was confirmed within the past 30 days prior to filing.
The Court has received no communication on this matter from Client. No opposition has been filed. A partys failure to oppose a motion is construed as a concession on the merits of the motion. (See D.I. Chadbourne, Inc. v. Superior Court (1964) 60 Cal.2d 723, 728, fn.4.)
SUPERIOR COURT OF CALIFORNIA COUNTY OF SACRAMENTO
23CV000374: CORDOVA FLORES vs LEDIN, et al. 08/05/2026 Hearing on Motion to be Relieved as Counsel in Department 8D
The motion is therefore GRANTED.
The Court will sign the proposed order submitted with the moving papers, which will be effective upon the filing of the proof of service of the signed order upon Client.
This minute order is effective immediately. No formal order or other notice is required. (Code Civ. Proc., § 1019.5; Cal. Rules of Court, rule 3.1312.)
