DEFENDANTS' MOTION TO STRIKE COMPLAINT is GRANTED as requested re: the entirety of paragraph 6 and parts of paragraph 9 of the prayer with leave to amend to allege that only restitution is sought under the UCL claim and facts giving rise to recovery of attorney's fees under CCP 1021.5.

Plaintiff shall have 10 days to file an amended complaint from notice of entry of order. If no amended Complaint is filed defendant shall file an answer thereafter. =(501/CFH)
