Cross-defendants seek judgment on the pleadings per CCP 438. CCP 439(a) requires that the parties shall "meet in confer in person, by telephone, or by video conference" prior to filing the motion. CCP 439(a)(3) also requires movant to provide a "declaration" regarding the meet and confer efforts. Here, movant merely sent a letter to the cross-complainants and claims there was no response. Movant also fails to provide a "declaration" regarding the meet and confer efforts. The parties are ordered to comply with the code.

The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
