Defendant Erica Kurien's motion to compel third-party Wells Fargo to produce records in response to subpoena is granted in large part. All records requested by the subpoena must be produced by Wells Fargo no later than August 24, 2026 after redacting social security numbers and any other private confidential information not bearing on whether Valencia Walker and/or Robert Stewart agreed to arbitrate any disputes either or both of them had with any Kaiser entity. The records requested by the subpoena are limited to healthcare enrollment documents and arbitration disclosures.
Kurien has shown that she has good cause to seek those records because they may include arbitration agreements covering the claims in this case. Those records typically do not include any information about an enrollee or her family's medical conditions or treatments and thus the normal concerns about disclosure of medical records are not applicable here.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 301 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept301tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion or Discovery Department. Parties may retain their own reporter, who may appear in the courtroom or remotely.
