Defendant's Demurrer to Second Amended Complaint is continued to April 17, 2026.
No later than April 1, 2026 Plaintiff's counsel to file a declaration (1) stating the date of death of each Plaintiff listed in the request for dismissal filed on February 18, 2026; (2) listing all allegations added to Second Amended Complaint specifically referencing each dismissed Plaintiff. (e.g. as to Plaintiff Matthew Byrd the following allegations have been added: paragraph number and text of the paragraph); (3) as to each allegation pertaining to each dismissed Plaintiff, counsel to provide a date when the facts/information regarding these allegations have been obtained from each dismissed Plaintiff; if information was not obtained from each dismissed Plaintiff directly, provide date and name of the person supplying the facts to counsel; (4) for each dismissed Plaintiff provide the date counsel was retained.
Plaintiff shall also file a supplemental brief (not to exceed 2 pages) providing authority allowing counsel to dismiss a case on behalf of a decedent.
No later than April 1, 2026 counsel for Defendant to file a declaration and a supplemental brief (not to exceed 2 pages) discussing the legal significance of Declaration of Christina Forst filed on January 21, 2026. Specifically, (1) is it Defendant's contention that this filing served as an automatic extension to respond; or (2) if it was not intended to serve as an automatic extension, did the Defendant obtain a court order for extension. If the filing was intended as an automatic extension, Defendant shall cite authority allowing for such extension. If the filing was not intended as an automatic extension provide authority as to the legal significance of this filing. =(501/CFH)
