ORDER RE: CASE MANAGEMENT AND ORDER TO SHOW CAUSE
The Court has ordered the following after review of the case, including timely filed Case Management Statements, without a conference.
Plaintiff has failed to serve the complaint and file a proof of service within 60 days of filing the complaint, in violation of Cal. Rule of Court 3.110(b). Pursuant to Cal. Rule of Court 3.110(f), the Court hereby issues an order to show cause why sanctions should not be imposed in the amount of $750 against Counsel. Pursuant to Cal. Rule of Court 3.110(i), any response to this order to show cause must be filed under oath and served at least 5 calendar days before the hearing. Plaintiffs counsel of record shall personally appear at the next hearing by video. Special appearance by counsel other than counsel of record, is not permitted. Plaintiff is also reminded to comply with Cal. Rule of Court 3.725(a), and shall, no later than 15 calendar days before the case management hearing, file a case management statement and serve it on all other parties in the case.
The Court sets this matter for an Order to Show Cause why sanctions should not be imposed for failure to comply with a Court Order. Order to Show Cause Re: Failure to File Proof of Service is set for 10/06/2026 at 02:30 PM in Department 15 at Rene C. Davidson Courthouse.
Failure to comply or appear may result in sanctions pursuant to one or more of the following: CRC 2.30, CRC 3.1340, CCP 177.5, CCP 575.2, CCP 583.150, CCP 583.360, CCP 583.410, CCP 583.420, CCP 583.430, and Government Code Section 68608.
If you contest the tentative ruling you must do so in a timely manner in accordance with the Local Rules. Failure to alert the Court and the opposing side or to appear will result in the Court affirming its tentative ruling. If the tentative ruling is uncontested, no appearance is necessary and the Court's tentative ruling will become a final order of the Court after the hearing.
