Given the parties have agreed to January 12, 2027, as the deposition date, the Court grant the motion and order the deposition to proceed on that date. The only remaining issue is sanctions. Defendant’s request for sanctions is denied because Defendant has not demonstrated to have properly met and conferred before filing the motion. Under Code of Civil Procedure section 2016.040, the meet and confer must occur in person, by telephone, or by videoconference. Sending emails is not code compliant. Therefore sanctions are not justified under the circumstances and are denied.
