NOTICE:
PLEASE TAKE NOTICE that effective April 13, 2026, this department has moved to the Tani G. Cantil-Sakauye courthouse located at 500 G Street in Sacramento, CA 95814. All hearings noticed for Department 25 will be heard in Department 8D of the new courthouse. Parties who wish to contest the tentative ruling below must: (1) request a hearing by calling the Department 8D Oral Argument Request Line at (916) 874-7719 no later than 4:00 p.m. on the Court day before the scheduled CMC, and (2) advise opposing counsel of the request.
If a hearing is not requested by 4:00 p.m. on the Court day before the scheduled CMC, the tentative ruling shall become the final order of the Court. The Court encourages parties to appear remotely for the hearing on the tentative ruling through the Courts Zoom Application. But, any party wishing to appear in person may do so, provided that party notifies the Court by 4:00 the Court day before the hearing. If a hearing is requested, the Court assumes that all parties will appear remotely via Zoom unless the Court orders inperson attendance.

If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. TENTATIVE RULING
The Motion for a Preliminary Injunction is DROPPED for defective filing/service and for failure to comply with this Courts order.
On May 27, 2026, Petitioner the Regents of The University of California (Petitioner) filed its operative and initiating pleading, Petition for Declaratory and Injunctive Relief. Shortly thereafter, Petitioner filed an ex parte application for injunctive relief, seeking injunctive relief pertaining to the discharge of Tanya Slovensky to a subacute care facility. On June 12, 2026, the Court (Judge Hardcastle) granted the ex parte application.
On June 29, 2026, Respondents filed an ex parte application, seeking a temporary stay of the transfer to subacute care and for an evidentiary hearing to be set to determine the appropriate care for Respondent Tanya Slovensky.
The Court (Judge Yap) granted, in part, the ex parte application on June 30, 2026, ordering a stay of the Courts June 12, 2026 order. The Court reserved a hearing date for Petitioner to file a motion for preliminary injunction to be hearing on August 3, 2026 and stayed the Courts June 12, 2026 order until a motion for preliminary injunction could be heard. The order states:
This matter is set for a motion for preliminary injunction on August 3, 2026 at 1:30 p.m. in Department 8D. Moving papers, opposition papers, and reply papers shall be filed and served in accordance with Code of Civil Procedure section 1005 and all applicable rules/statutes based on the hearing date. The Parties confirmed at hearing that service has been properly effected in this case.
(June 30, 2026 Order, p. 3:5-8 (emphasis added).)
Petitioner has filed no moving papers in support of a motion for preliminary injunction in advance of the August 3, 2026 hearing date. The Court notes that Petitioners original Ex Parte Application filed on June 5, 2026 did not seek preliminary injunctive relief; as such, it did not provide notice of such relief for purposes of the reserved August 3, 2026 hearing date. Further, the Court notes that the declarations in support of the original ex parte relief appear to be out of date in light of the representations made in the ex parte filing.

Accordingly, the instant motion must be dropped for failure to comply with Code of Civil Procedure section 1005 and for failure to comply with the Courts June 30, 2026 order.
Nothing in this Order prevents Petitioner from filing and serving a motion for preliminary injunction. If the hearing date on such a motion is too remote, Petitioner may seek ex parte relief to advance the hearing, if such request is sufficiently supported.
The Court notes that nothing in this Order changes the Courts June 30, 2026 Order, which provides for a stay of the Courts June 12, 2026 Order until the motion for preliminary injunction can be heard. The June 12, 2026 Order remains stayed, as no motion for preliminary injunction has been filed (or heard).
