Plaintiff Michelle Fuller's motion for a protective order regarding the taking of her deposition is DENIED.
Plaintiff moves under Code of Civil Procedure section 2025.420, which provides that: "The court, for good cause shown, may make any order that justice requires to protect any party, deponent, or other natural person or organization from unwarranted annoyance, embarrassment, or oppression, or undue burden and expense." (Code Civ. Proc. 2025.420, subd. (b).)
The court finds that Plaintiff has not shown good cause for a protective order. Defendants Sutton National Insurance Company and Bamboo Ide8 Insurance Services, LLC have made clear that they are willing to accommodate Plaintiff's employment schedule and notice her deposition for a weekend; Plaintiff has not demonstrated that a weekend deposition would cause her undue burden. Plaintiff has similarly not met her burden to show the necessity of a protective order regarding the location of the deposition, the time limit of the deposition, or any pre-notice meet and confer requirements.
Additionally, the time limit issue was already resolved by this court's January 20, 2026 Order granting Defendants' motion to increase the time limit on Plaintiff's deposition. Plaintiff is ordered to appear for deposition within 30 days' notice of this order. (See Code Civ. Proc. 2025.420, subd. (g) ["If the motion for a protective order is denied in whole or in part, the court may order that the deponent provide or permit the discovery against which protection was sought on those terms and conditions that are just"].)
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom.
