2025CUOE043552: SERGIO GARCIA vs JUNEBUG VETERINARY CORP., INC., et al.
At issue in both motions is disclosure of information regarding covered employees, defined as: all persons who are or were employees of DEFENDANT, in the State of California during the time period commencing February 12, 2024, to the present] who was employed by DEFENDANT during the PAGA TIME PERIOD. In the responsive separate statement, Defendant states that the contact information for the covered employees (those employees who could be considered aggrieved during the time frame at issue under the Private Attorneys General Act (Lab. Code, § 2698 et seq.)) has been provided. As a result, a Belaire-West notice - advising other employees that they can elect not to have their contact information provided to Plaintiff - is no longer at issue. (Belaire-West Landscape, Inc. v. Superior Court (2007) 149 Cal.App.4th 554.)
Plaintiff responds, stating that Special Interrogatories 3-6 and 9-15, and Inspection Demands 2-10 remain at issue. Inspection Demands 2-10 and Special Interrogatories 3-6 and 9-15 relate to alleged violations for other employees of wage and hour laws The requested information is clearly relevant to Plaintiffs PAGA case, and Defendant cites no authority that such discovery is not discoverable until such time that a particular employee has consented to such discovery or has been given notice that such information is being sought.
Defendant is ordered to provide code compliant, verified further responses, without objection, on or before August 21, 2026
Moving party is ordered to serve notice of the Courts ruling.
