TENTATIVE RULING:
On July 22, 2026, Defendant Capital Christian Center (Defendant) filed an ex parte application to continue the August 17, 2026 trial date on the grounds that Defendants attorney of record, Mark Berry, retired on June 30, 2026, and Defendants new (as of July 1, 2026) attorney of record, Vladamir F. Kozina, is currently scheduled for multiple trials during the month of August 2026. Defendant stated in the ex parte application that Plaintiffs counsel indicated they would not oppose the application.
On the same day, the Honorable Steven M. Gevercer set the matter for hearing on July 31, 2026, since a stipulation did not accompany the ex parte application. Judge Gevercer ordered a noticed motion to be filed no later than July 27, 2026, at 4:30 p.m., and ordered the parties to appear at the July 31st hearing to address the trial setting date.

Defendant filed its moving papers on July 24, 2026, as ordered. However, in a supplemental declaration, Mr. Kozina avers that he misunderstood Plaintiffs counsel regarding whether Plaintiffs would oppose the motion. (Supp. Decl. of Kozina ISO Mot. ¶ 2.) Mr. Kozina avers that Plaintiffs counsel has indicated she needs to check with her clients concerning their position on a continuance. (Id. at ¶ 3.)
The parties remain ordered to appear at the hearing to address the pending motion to continue trial and a trial setting date.
This minute order is effective immediately. No formal order or other notice is required. (Code Civ. Proc., § 1019.5; Cal. Rules of Court, rule 3.1312.)
*** This case has been assigned to Department 17A for hearing. In the event that either party requests a hearing the matter will be heard at 9:30 a.m. in Department 17A. Any party requesting an oral argument must contact the clerk at (916) 874-5487 and opposing counsel or parties in pro per by 12:00 p.m. on the court day before the hearing. If a proper request for hearing is not made, this shall become the order of the Court.
Parties requesting services of a court reporter will need to arrange for private court reporter services at their own expense, pursuant to Government Code section 68086 and California Rules of Court, rule 2.956. If a litigant has been granted a fee waiver and requests a court reporter, the party must submit a Request for Court Reporter by a Party with a Fee Waiver (CV/E-211) and it must be filed with the clerk at least 10 days prior to the hearing or at the time the proceeding is scheduled if less than 10 days away. Once approved, the clerk will forward the form to the Court Reporters
