FORBES CASE NUMBER: 25CV-0208759 Tentative Ruling on Order to Show Cause Re: Sanctions: An Order to Show Cause Re: Sanctions (“OSC”) issued on June 16, 2026 for Plaintiff’s failure to seek a default judgment as required by CRC 3.110(h). CRC 3.110(h) requires a plaintiff to obtain a default judgment within 45 after default is entered.

Default was entered on November 10, 2025 and therefore Plaintiff was required to obtain a default judgment within 45 days. No default judgment has been obtained. Plaintiff has not submitted a response to the OSC. Without any explanation for Plaintiff’s failure to comply with CRC 3.110(h), the Court will impose sanctions in the amount of $250 against Plaintiff and counsel. The clerk is instructed to prepare a separate order of sanctions. The Court will issue a new Order to Show Cause Re: Monetary Sanctions in the amount of $500 to Plaintiff and Counsel for their failure to comply with CRC 3.110(h).
