Plaintiffs Motion for an Order Allowing Discovery of Financial Condition Information is DENIED.
Plaintiffs claims against Defendant are based on (1) Defendants alleged failure to pay the amounts owed on legal bills that Defendant had earlier represented he would pay, and (2) Defendants alleged recording of confidential communications, which consisted of the parties' attempts to informally meet and confer concerning their discovery obligations in this case.
Assuming for the purposes of this motion that all the facts set forth in Plaintiffs declaration are true, Defendant may potentially be found liable for punitive damages. Plaintiff has not, however, demonstrated a substantial probability that he will prevail on his claim for punitive damages, as required by Civil Code section 3295(c).
