3 - Plaintiff Tibor Szabo's Motion For Judicial Entry Of Default And Reconsideration Of Clerks Rejection is DENIED. The filing of a responsive pleading, even if late, prevents the entry of default. (Goddard v. Pollack (1974) 37 Cal.App.3d 137, 141.) Here, Defendant Regents of the University of California filed a demurrer, which is a responsive pleading, and the court has adjudicated the demurrer. (See Code of Civil Procedure section 430.10.) On this record, the court declines to reconsider the clerk's rejection of Plaintiff's notices of default; the court, however, notes that the clerk's actions are well documented, and Plaintiff has not established they were inappropriate.

The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
