Tentative Ruling
In pro per Plaintiff Adam Jacobs (Plaintiff) motion to deem matters admitted is UNOPPOSED and GRANTED.
The Court is required to make this order deeming the requests for admissions admitted, unless Defendant Fawaz Almosleh (Defendant) serves on Plaintiff and files with the Court, before the hearing on the motion, verified responses to the requests for admission, without objections, that are in substantial compliance with Code of Civil Procedure section 2033.220.
Plaintiff served Defendant with a second set of requests for admission on May 18, 2026. No response has been provided.
The matters specified in the requests for admission are deemed admitted.
Pursuant to Code of Civil Procedure section 2033.280, subdivision (c), the Court imposes a mandatory monetary sanction in the amount of $11.49, which comprises $11.49 in postage/service fees. (See Decl. of Adam Jacobs ISO Mot. ¶ 10.) The Court declines to award an additional $60.00 in motion fees as Plaintiff was granted a fee waiver before the instant motion was filed. (See Order on Court Fee Waiver, June 11, 2025.)
Defendant shall pay the sanction no later than August 28, 2026. If the sanction is not paid by such date, Plaintiff may lodge for the Courts signature a formal order awarding sanctions, which may be enforced as a separate judgment. (See Newland v. Superior Court (1995) 40 Cal.App.4th 608, 615.)
Plaintiff shall provide notice of this ruling and file proof of service of same within five (5) calendar days.
This minute order is effective immediately. No formal order or other notice is required. (Code Civ. Proc., § 1019.5; Cal. Rules of Court, rule 3.1312.)
