Under Code of Civil Procedure section 472, a party may amend its pleading once without leave of court at any time after a demurrer is filed but before the opposition to the demurrer is due. Plaintiff did so here by filing an amended complaint on July 15, 2026. The demurrer and motion to strike are therefore moot. The demurrer is overruled as moot and the motion to strike is denied as moot on that ground.
ORDER (PROPOSED)
Based on the filing of the First Amended Complaint, the demurrer is overruled as moot and the motion to strike is denied as moot.
