24CV105144: CALDERA, et al. vs RODRIGUEZ, et al. 07/27/2026 Hearing on Motion to Deem Request for Admissions Admitted filed by Jose Caldera (Plaintiff) CRS# A-105144-003 in Department 19

Tentative Ruling - 07/22/2026 Joscelyn Jones

The Motion to Deem RFA's Admitted filed by Jose Caldera on 06/16/2026 is Granted.

Plaintiff Jose Caldera’s Motion to Have Requests for Admissions Set One Deemed Admitted against Defendants Clemente Rodriguez, Teresa Rodriguez, and CR Construction LLC is GRANTED.

Defendants’ request that the motion be denied because it was served one day later than required by the Code of Civil Procedure is DENIED. This motion was continued from its prior hearing date of July 13 to July 27. Defense counsel was served with this motion 41 days before the continued hearing date and he demonstrates no prejudice from the one day delay in service of the motion.

Sanctions of $610 are awarded to Plaintiff Jose Caldera against Defendants, jointly and severally (but not against defense counsel.)
