TENTATIVE RULING:
Good cause appearing and no opposition having been received, Defendant Stran Loyalty Solutions, LLCs (Defendant) motion to transfer this action to the Superior Court of California, County of Orange is GRANTED.
The notice of motion fails to provide notice of the Courts tentative ruling system for the Law and Motion calendar in the Presiding Judges department. (See Local Rule 1.05(C)-(D).) Moving counsel is directed to contact opposing counsel and/or self-represented litigants and advise them of Local Rule 1.05, the Courts tentative ruling procedure, and the manner to request a hearing. If moving counsel is unable to contact opposing parties prior to hearing, moving counsel is ordered to appear at the hearing by Zoom or by telephone.

This is a wage and hour action arising out of Plaintiff Kailan Straws former employment with Defendant, a Nevada Limited Liability Company. Defendants Statement of Information filed with the Secretary of State lists an Irvine, California address as its principal place of business. Irvine is located in Orange County, California. The parties Employment Agreement states that it is deemed made and entered into in Irvine, California. The Employment Agreement further states that the parties thereto consent to venue in Orange County, California. (Decl. of Bruce Batcheller ISO Mot. ¶¶ 2-3, Ex.

A.) Based on this information, the Court finds Sacramento County is an improper place for trial and Orange County is a proper place for trial. (Code Civ. Proc., §§ 395, subd. (a), 395.2; see also Battaglia Enterprises, Inc. v. Super. Ct. (2013) 215 Cal.App.4th 309, 318 [[W]here . . . parties agree . . . to litigate an action in one of multiple statutorily permissible venues, they should be held to their agreement.].) Code of Civil Procedure § 396a, subdivision (b) therefore requires this action be transferred.
Defendants motion is granted. The action shall be transferred to the Orange County Superior Court upon payment of the transfer fees. As the grounds for transfer are based on the commencement of the action in an improper court, Plaintiff shall pay the transfer fees. (Code Civ. Proc., § 399, subd. (a).)
This minute order is effective immediately. No formal order or other notice is required. (Code Civ. Proc., § 1019.5; Cal. Rules of Court, rule 3.1312.)
