NOTICE: PLEASE TAKE NOTICE that pursuant to Public Notice Civil Division 2025 Law and Motion Calendars any oral arguments regarding this tentative ruling will be heard in Department 25, located at 720 9th Street, Sacramento, CA, the Hon. Julie G. Yap presiding. Should argument be requested by either party, the requesting party must call the Law and Motion Oral Argument Request Line at (916) 874-2615, by 4:00 p.m. the Court day before the hearing, request the hearing, and notify the opposing party of the location and time of hearing pursuant to Local Rule 1.06.
At the time of requesting oral argument, the requesting party shall leave a voice mail message: a) identifying themselves as the party requesting oral argument; b) indicating the specific matter/motion for which they are requesting oral argument; and c) confirming that it has notified the opposing party of its intention to appear and that opposing party may appear via Zoom using the Zoom link and Meeting ID indicated below. If no request for oral argument is made, the tentative ruling becomes the final order of the Court.

Once the form is signed it must be filed with the clerk. TENTATIVE RULING:
This matter was initially continued from August 18, 2025, to this date, at the request of the parties. In continuing this matter, the Court ordered parties to file a joint statement by no later than October 20, 2025.
According to the Courts electronic record, on October 20, 2025, Counsel for Plaintiff Samson Vizgaudis (Plaintiff) and Defendants Lennox Industries, Inc. (Lennox) and Byron Trejo (Trejo) (collectively, Defendants) submitted their Joint Statement Stipulating to Stay Discovery Pending Mediation, which addressed the pending motions to compel written discovery. In their joint statement, the parties represent the following:
On July 1, 2025, counsel for Defendants and counsel for Plaintiff met and conferred by phone. The Parties agreed to schedule private mediation in this matter and to temporarily stay any outstanding discovery issues pending mediation. Plaintiffs counsel has also agreed to allow Defendants to conduct Plaintiffs deposition prior to the mediation. (Joint Stmt., p. 2 at ¶ 2.)
On October 2, 2025, the Parties attended mediation with Linda Meyer, Esq. The Parties did not resolve this matter at mediation. (Id. at ¶ 4.)
The Parties are unable to agree to a date upon which to continue the Hearing and associated deadlines and submit the following separate statements. (Id. at ¶5.)
Pursuant to the request of the parties, this matter is CONTINUED to December 15, 2025, at 1:30 p.m., in this department.
The Parties shall meet and confer no later than November 24, 2025. The parties are directed to meet and confer in person, telephonically, or by video conference.
After thoroughly meeting and conferring in an attempt to resolve each and every discovery request that the motion currently encompasses, and no later than December 3, 2025, moving counsel shall file a joint statement indicating which discovery requests have been resolved, and which requests (if any) remain outstanding.
