The settlement administrator, Phoenix Settlement Administrators, has confirmed that the distribution of the settlement funds has been completed and made in accordance with the terms of the settlement that were approved by the Court.

As Plaintiff has shown that the administrator’s work is complete, the Court’s file may now be closed.

Final Accounting

The Court’s previous minute order continued the Final Accounting hearing from 5/21/2026 to 7/23/2026 “to confirm that the amount of the uncashed checks after the check-cashing deadline has been delivered to the State Controller’s Office Unclaimed Property Fund in the names of the applicable payees, that the administrator’s work is complete, and that the Court’s file thus may be closed.” (ROA #155, emphases added.)

In advance of this 7/23/2026 hearing, the parties filed on 6/29/2026 a supplemental declaration from the administrator dated 6/22/2026 in which the administrator attested only that uncashed “funds shall be remitted [to the State Controller] on or about June 30.” (ROA #157, ¶ 4.)

Accordingly, the parties have not provided confirmation that the uncashed funds have already been delivered to the State Controller and that the administrator’s work is complete.

Therefore, the Court must further CONTINUE the Final Accounting hearing to August 6, 2026 at 2:00 p.m. in Department CX102 to confirm that the amount of the uncashed funds after the check-cashing deadline has been delivered to the State Controller’s Office Unclaimed Property Fund in the names of the applicable payees, that the administrator’s work is complete, and that the Court’s file thus may be closed. All supporting papers must be filed at least sixteen (16) court days before the continued hearing date. If the parties are unable to provide such confirmation by this date, the parties shall seek a further continuance of the hearing instead of submitting another premature declaration by the administrator stating that the administrator’s work is not yet complete.

Plaintiff is ordered to give notice of this ruling to Defendant.
