Notice Of Motion And Motion To Lift Stay And For Leave To Amend Complaint

Plaintiff Isabel Cantu's motion to lift stay and for leave to amend complaint is granted in part. The stay imposed by the February 18, 2025 order is lifted and Cantu is granted leave to file a first amended complaint that adds Yunuen Bautista as a named plaintiff to allege only claims and only for such time periods that have not been released or resolved by De Alba cases (Alameda County Superior Court cases 23CV034590 and 23CV048946).
Because the only matters remaining in those cases is administration of the court-approved settlement terms reflected in a final judgment, the stay is lifted by its terms and there is no reason that the stay should remain in place. Cantu recognizes that it would be inappropriate to re-litigate any claims released or resolved in the De Alba cases and states in her reply memorandum on this motion that she has no intention of doing so. Accordingly, her first amended complaint may allege only claims and only for such time periods that have not been released or resolved by De Alba cases.

The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
Counsel for the prevailing party is required to prepare a proposed order which repeats verbatim the substantive portion of the tentative ruling and must email it to contestdept302tr@sftc.org prior to the hearing even if the tentative ruling is not contested.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
