ORDER RE: CASE MANAGEMENT AND TRIAL SETTING ORDER WITH NOTICE

The Court has ordered the following after review of the case, including timely filed Case Management Statements, without a conference.

TRIAL SETTING ORDERS

Jury Trial is scheduled for 08/16/2027 at 10:00 AM in Department 18.

The parties are ordered to comply with the Standing Pre-Trial Orders for Civil Cases, Local Rule of Court 3.35.

The Compliance Hearing scheduled for 08/19/2026 and the Case Management Conference scheduled for 07/22/2026 are continued to 08/26/2026 at 01:30 PM in Department 18 at Rene C. Davidson Courthouse.

Trial is scheduled in light of the October 5, 2027 last day to bring this matter to trial. A deadline for filing a motion for class certification or motions for summary judgment/adjudication is not scheduled at this time, and the parties are directed to further meet-and-confer and propose a joint schedule before the next conference that permits necessary motion practice before the trial date. The court has some concern that Plaintiffs' proposal for a March 2027 class certification motion hearing does not allow sufficient time to bring this matter to trial if the motion is granted. The parties are to file a joint updated case management conference statement on pleading paper at least 7 days before the next conference.

The compliance hearing for the pro hac vice admission of Joseph A. Gomes is continued from August 19 to August 26 due to court unavailability.

The Compliance Hearing re: Scheduling of Motion for Class Certification scheduled for 08/19/2026 is vacated.

The Court orders counsel to obtain a copy of this order from the eCourt portal.

CONTESTING THE TENTATIVE CASE MANAGEMENT ORDER: If the parties do not contest the Tentative Case Management Order, it will be adopted.
