The petition of Patrick Krzyzosiak and Teresa Parker to confirm the arbitration award issued on 5/26/2026 by Elizabeth A. Tippin is GRANTED pursuant to Code of Civil Procedure section 1286.

Petitioners' request for pre-judgment interest dating from 5/26/2026 is DENIED. Arbitrator Tippin expressly disallowed interest due to claimants' "excessive demand." (See Pet. Att. 8(c) at p. 9.)

Respondents provided evidence that they have satisfied the award in full. (Speciale Decl. Exs. B- D.) Petitioners have not filed a reply disputing that they received the payments. However, Respondents have not cited legal authority that authorizes the Court to deny a petition to confirm an award due to the satisfaction of the award after the petition was filed. In light of the evidence that the award was satisfied, however, the Court directs Petitioners to immediately file acknowledgement of satisfaction of the judgment under CCP section 724.030.

The petition is GRANTED. The Court enters judgment in favor of Petitioners in the amount of $605,031.70. Petitioners shall file acknowledgement of satisfaction of the judgment amount pursuant to CCP section 724.030.

Petitioners shall lodge a proposed judgment within 7 days of this order and email the proposed judgment to Department 514 at dept514@alameda.courts.ca.gov.
