Grant, in part. The court finds that the Trust, Article Eight, paragraph titled Successor Beneficiaries, page 4-8 contains a scrivener’s error. The court grants the petition to correct the scrivener’s error.

As to the request to approve the first and final account and report: The court intends to disallow the reserve request of $25,000.00.

Trustee Fees: Trustee requests trustee fees of $ $22,603.50. Objector argues that the amount of time charged by the trustee through April 6, 2026 is excessive and should more appropriately be reduced to 350 hours and that the hourly rate should be reduced to not more than $35 per hour.

Objector offers no reason why 350 hours is appropriate in this matter. Objector has not objected to any particular time entries.

This is a non-court supervised trust.

The trust provides, at Article Seventeen:

Trustee’s Compensation: The trustee shall receive as compensation for its services, unless waived, such amount of commissions as are customarily being charged by commercial trust companies for services as trustee of an intervivos trust in the State of California. The Trustee shall be entitled to reimbursement for any expenses of the trust that the Trustee has paid.

Petitioner to provide a request for trustee fees that complies with Article 17 of the trust, or Probate Code §15680.

The court intends to approve reimbursement of $685.50 for expenses for the period April 27, 2025 to April 6, 2026.

As to Objector’s Request for Attorney Fees: Notice of the request for fees has not been given, and an itemization of attorney time spent has not been provided.

The court intends to deny the request for attorney fees to Objector.
