The Court's Order of 6/9/2026 outlines the procedural history of this action as it relates to the arbitration. The Court stated: "The Court continued the CMC [from 5/29/2026] to 6/17/2026 and ordered the parties to file case management statements by no later than 15 days prior to the CMC. No statements have been filed. Accordingly, the Court continues the matter to allow the parties to filed statements advising the Court of what further court proceedings, if any, are contemplated. If the Court does not receive any timely case management statements, the Court will presume that no further judicial intervention is required and that dismissal of the action without further notice is appropriate." (6/9/2026 Order.)

As no statement have been filed, it is apparent that no further judicial proceedings are necessary or contemplated by the parties. Therefore, the action is dismissed without prejudice.
