Case: Cotner et al. v. Singh et al. Case No. CV2023-1742 Hearing Date: July 15, 2026 Department Thirteen 9:00 a.m.

Defendant Gurnam Singh’s motion for leave for an independent neuropsychological examination of plaintiff Sydnie Cotner is DENIED. (Code Civ. Proc., §§ 2032.020, 2032.310.) The Court finds that non-expert discovery deadlines closed prior to defendant filing this motion, and that defendant did not file a motion to reopen discovery as required by Code of Civil Procedure section 2024.050 prior to or in conjunction with the filing of this motion. (Pelton-Shepherd Industries, Inc. v. Delta Packaging Products, Inc. (2008) 165 Cal.App.4th 1568, 1586-1857 [prejudicial abuse of discretion for court to grant discovery motion when moving party has not moved to reopen discovery under Code of Civil Procedure section 2024.050; see also Code Civ. Proc. § 2024.020; Order re ex parte application, [3/26/26]; Ebert Decl., ¶¶ 15, 18-19.)

The notice of motion does not provide notice of this Court’s tentative ruling system as required by Local Rule 11.2(b). Counsel for moving party, or the moving party if unrepresented by counsel, is ordered to notify the opposing party or parties immediately of the tentative ruling system.

If no hearing is requested, and no party appears at the hearing, this tentative ruling is effective immediately. No formal order pursuant to California Rules of Court, rule 3.1312 or further notice is required.
