ORDER RE: CASE MANAGEMENT
The Court has ordered the following after review of the case, including timely filed Case Management Statements, without a conference.
The Court is satisfied that other potential shareholders of Robertos Inc., including those who are presently participating in the Hawaii Probate Proceeding (Estate of Roberto Ting Siu, Circuit Court of the First Circuit, State of Hawaii, Case P No. 17-1-000667) have received notice of the proposed settlement of derivative claims and this court's order setting a deadline for any objections. No objections have been filed, nor has the Court received any objection to the settlement via informal channels (e.g., email).
The Court is therefore inclined to sign the parties' proposed order approving the proposed settlement and maintain the 8/5/2026 hearing re: dismissal. (Should the parties require a continuance of that hearing, they should file a stipulation or ex parte application, supported by an explanation, under oath, supporting good cause.)
The Compliance Hearing nonappearance (review proposed settlement) scheduled for 07/15/2026 is vacated.
