Procedural History 17 1) Walter Alexander Cea Alvarado (Father) and Sandra Irene Lopez Zuniga (Mother) have one 18 minor child, Zayden (DOB: 9/22/2018, age 7). 19 2) On for hearing is Mother’s 4/15/2026 Request seeking joint legal and physical custody of 20 Zayden, with the following parenting time schedule: Mother: Monday and Tuesday nights; 21 Father: Tuesday and Wednesday nights; parties: alternate weekends.
Mother states the parties are 22 currently following an informal and inconsistent schedule, which has led to confusion, instability, 23 and unnecessary tension between the parties. 24 3) The parties attended mediation and were unable to reach an agreement. Father’s request is as 25 follows: Week 1: Mother: Tuesday and Thursday; Father: Monday, Wednesday, Friday, Saturday, 26 and Sunday; Week 2: Father: Tuesday and Thursday; Mother: Monday, Wednesday, Friday, 27 Saturday, and Sunday. Both parties would like the exchanges to occur at Mother’s residence at 28 8AM when school is not in session. 29
1 B. Findings and Orders 2 1) This Court has jurisdiction to make child custody orders in this case under the Uniform 3 Child Custody Jurisdiction and Enforcement Act. A violation of this order may subject the party 4 in violation to civil or criminal penalties, or both. The country of habitual residence of the minor 5 child is the United States. 6 2) The Court finds it is in Zayden’s best interest for the parties to share joint legal and physical 7 custody of Zayden, with parenting time as follows: Mother: Monday school pick up to 8 Wednesday school drop off; Father: Wednesday school pick up to Friday school drop off; parties: 9 alternate weekends, from Friday school pick up to Monday school drop off.
All custody 10 exchanges shall occur at Mother’s home, curbside, at 8AM when school is not in session. 11 3) If the parties wish to make changes to the above schedule, they may do so by agreeing to a 12 different schedule in writing (text message or email is acceptable). If they are unable to agree 13 regarding changing the schedule, either party may file a new request for order with the Court. 14 4) The Court will prepare the Findings and Order After Hearing. 15
