DEMURRER to COMPLAINT
Matter on calendar for Tuesday, July 14, 2026, Line 3, DEFENDANT WARWICK AMUSEMENTS CORPORATION, WARWICK CALIFORNIA CORPORATION's DEMURRER to COMPLAINT.
4 - Defendant Warwick California Corporation's demurrer to plaintiff Jane Doe's complaint is off calendar as moot in light of the granting of plaintiff Jane Doe's motion for leave to file a first amended complaint. (Brown and Weil, California Practice Guide: Civil Procedure Before Trial (TRG 2025 Update) 6:704).
Because the court assumes that Warwick California Corporation likely desires to make some or all of the arguments raised in this demujrrer in a pleading motion directed to the first amended complaint and the trial date is fast approaching, the court will entertain a stipulation by the parties for an expedited briefing and hearing schedule based on re-filed (presumably heavily cut and pasted) papers with a hearing date on or before July 27, 2026 provided that courtesy copies of all papers are delivered to department 302 at least four calendar days before the hearing.
For the 9:00 a.m. calendar, all attorneys and parties may appear in Department 302 remotely or in person. Remote hearings will be conducted by videoconference using Zoom. Any party who contests a tentative ruling must send an email to contestdept302tr@sftc.org with a copy to all other parties by 4pm stating, without argument, the portion(s) of the tentative ruling that the party contests. The subject line of the email shall include the line number, case name and case number. The text of the email shall include the name and contact information, including email address, of the attorney or party who will appear at the hearing.
The court no longer provides a court reporter in the Law & Motion Department. Parties may retain their own reporter, who may appear in the courtroom or remotely. A retained reporter must be a California certified court reporter (CSR), for only a CSR's transcript may be used in California courts.
