On May 8, 2026, defendant Michael Smith filed a motion to change venue and transfer this action to the Superior Court of Orange County.
That motion to change venue is set for hearing on August 24, 2026. On June 1, 2026, defendant Smith filed a motion to quash deposition subpoenas for production of business records. This motion to quash is set for this hearing. "A motion to change venue operates as a supersedeas or stay of proceedings." (South Sutter, LLC v. LJ Sutter Partners, L.P. (2011) 193 Cal.App.4th 634, 655.) The motion to quash will therefore be continued to be heard on August 24, 2026, after disposition of the motion to change venue.
